Website is provided for personal information and non-commercial use worldwide to its Users/Purchasers. Users may browse http://drbrianscott.com/; however, access to and use of the drbrianscott.com website is subject to the (“Terms and Conditions”) below and all applicable laws.

Users/Purchasers shall not post or transmit through http://drbrianscott.com/ any information or material which violates or infringes in any way upon the rights of others, or which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, harassing, or otherwise objectionable.

TELEHEALTH INFORMATION DISCLOSURE STATEMENT

User/Purchaser understands that if they elect to engage in telehealth (e.g., internet, video-based or telephone-based therapy) with Dr. Brian Scott for a functional medicine or other consultation, and to establish a doctor/patient relationship, Dr. Scott must see User/Purchaser in person for an initial consult and examination. If User/Purchaser does not see Dr. Brian Scott in person for a consult and examination, there will not be a doctor/patient relationship established. Instead, Dr. Brian Scott’s communications with User/Purchaser will be for educational purposes only. Communication will be deemed as “Telehealth/Education Services”. These services provided to the User/Purchaser will consist of information and suggestions that are intended to assist User/Purchaser and their health care provider in using natural means to support the User/Purchaser’s health. Telehealth/education services are not intended to serve as a medical diagnosis or treatment of any kind. Fees for telehealth/education services will be established and mutually agreed upon by both Dr. Brian Scott and the User/Purchaser. User/Purchaser is responsible for all payments for all telehealth/education services as agreed upon. Please note that medical insurance does not cover telehealth/education services and Dr. Brian Scott will not bill any insurance companies for telehealth/education services.

 

LICENSE, WARRANTS AND REPRESENTATIONS

FORCE MAJEURE

Integrative Functional Medicine Solutions will be free of liability to the User/Purchaser if prevented from executing its obligations under this Agreement in whole or in part as a result of Force Majeure, including, but not limited to; pandemics, earthquake, typhoon, flood, fire, and war or any other unforeseen and uncontrollable event where Integrative Functional Medicine Solutions has taken any and all appropriate action to mitigate such an event.

 

INFORMATION PROVIDED BY USER/PURCHASER

REFUND POLICIES AND FEES

Integrative Functional Medicine Solutions may remedy any non-conforming Product by providing a refund of the purchase price or at Integrative Functional Medicine Solutions sole discretion, repair or replace any or all of the Product.

 

All returns must have prior authorization. Please email info@drbrianscott.com to obtain a Return Authorization Number. Please include the Return Authorization Number inside the package.

Users/Purchasers will be issued a refund (less a 30% restocking fee) up from 15% within 14 days of product purchase from the http://drbrianscott.com/ Shop upon the return, at the Purchaser’s expense for the full paid amount of the product, of unused, unexpired, unopened (seals/wrappers intact), undamaged products. Please allow 10 days for a refund to be issued via credit card or check. Failure to comply with the above instructions will affect the processing of purchaser’s return. In the event of the original Purchasers/Users death after 14 day refund period, no refund will be given to family members or executors of the estate

No refunds will be issued after 14 days.

If User/Purchaser decides to terminate or cancel their already paid Telehealth/Education services, no refund will be issued. Any labs ordered, paid for and submitted for processing cannot be cancelled.

Returned checks will be assessed any and all bank fees associated with the Non Sufficient Funds (NSF) in addition to a 10% re-processing fee.

SHIPPING

Products purchased directly from the ifunctionalmedicinesolutions Shop will be shipped within 1-3 business days from receipt of the order. Orders that qualify for free shipping (orders over $100) will also be shipped within 1 to 3 business days of receipt. Carriers are selected at the time and discretion of the Shipper. Shipping times may vary based on your shipping address, carrier delays and product availability. Purchases made through a third-party site will be shipping according to their shipping Terms and Conditions.

Shipping hours are Monday through Friday 9:00AM to 3:00PM EST, excluding holidays.

 

GOVERNING LAW

The laws of the State of Virginia shall govern these Terms and Conditions, without giving effect to any principles of conflicts of law. If any provision of this agreement and Terms and Conditions shall be unlawful, void, or for any reason unenforceable then that provision shall be severable from these Terms and Conditions shall not affect the validity and enforceability of any remaining provisions.
